With Singapore's accession to the International Convention for the Protection of New Varieties of Plants (UPOV Convention) and the enactment of the Plant Varieties Protection Act in 2004, plant breeders in Singapore can seek rights protection of their new plant varieties for 25 years.
Plant breeders who wish to protect their new varieties have to apply at the Plant Varieties Protection Registry located at the Intellectual Property Office of Singapore (IPOS). Information on the fundamentals of protection of plant varieties and on the filling of application for plant protection can be found at the IPOS website.
Currently, new varieties of 15 plant genera or species are eligible for protection. Protection will be extended to all plant species in 10 years time.

As part of the application process for protection, the breeder would be notified by Intellectual Property Office of Singapore IPOS to submit their plant materials to AVA's Horticulture Services Centre (HSC) for technical examination (DUS test). Only the candidate plant variety that meets the following criteria will be granted Rights protection:
- Novelty
- Have a suitable denomination
- Distinctness
- Uniformity
- Stability
